What Makes an eBike Legal in Australia?

You’re sitting outside a winery in McLaren Vale when someone zips past on an eBike — no pedalling, doing close to 40 km/h. You might think, that doesn’t look right.

And you’d be correct.

Not every bike with a motor counts as a legal eBike in Australia. To be road-legal, an eBike must meet the European Standard EN 15194, which sets clear rules about power, speed, and how the motor works. At SA eBikes, every bike in our fleet is fully compliant, so when you ride with us, you know you’re safe and legal.

The 4 Golden Rules of eBike Compliance

  1. Motor power limit
    The motor can’t be more than 250 watts continuous rated power. Anything stronger is classed as a motorbike.
  2. Speed cut-off
    The motor must stop helping once you reach 25 km/h. Pedal harder if you want to go faster, but the motor won’t do it for you.
  3. Pedal assist only
    You need to pedal to get help from the motor, and the assistance must be smooth and progressive.
  4. Voltage limits
    Electrical systems must stay within 48 V DC, and chargers need to safely use Australia’s 230 V ACsupply.

What About Throttles?

Full throttles — where you twist and go without pedalling — are generally not legal on public roads. They turn an eBike into a motorbike in the eyes of the law.

There are two exceptions:

  1. 6 km/h “walk assist” throttle– helps you push the bike up a hill or through tricky spots while walking.
  2. eBikes with 200W motors– can have full throttle while riding, as allowed under EN 15194.

Why Compliance Matters

Riding a non-compliant eBike can lead to:

  • Fines — for effectively riding an unregistered motorbike without a licence.
  • Insurance gaps — you may not be covered if there’s an accident.
  • Safety risks — illegal bikes often cut corners on brakes, wiring, or batteries.
